|a هدفت هذه الدراسة إلى بيان الحقوق المادية والمعنوية التي أقرتها الشريعة الإسلامية للطفل في القرآن الكريم والسنة النبوية المطهرة، فهذه الحقوق التي وردت في الاتفاقيات والمواثيق الدولية في عصرنا الحاضر سبق أن أقرها الإسلام، وقد اتبعت المنهج الوصفي القائم على التحليل في دراسة وبيان حقوق الطفل في الإسلام، مع الإفادة من المنهج الاستقرائي، واستعرضت في هذه الدراسة مفهوم الطفولة وحقوق الطفل منذ ولادته، لأخلص في نهاية هذا البحث إلى أن الشريعة الإسلامية ضمنت للطفل الحقوق كامله غير منقوصة سواء أكان له أب أو كان يتيما أو لقيطا مجهول النسب، وسواء في الظروف العادية أو في حالات النزاعات المسلحة، وسواء أكان الطفل ذكرا أم أنثى، وبينت في هذه الدراسة أن حقوق الطفل في الإسلام ليست واجبة على الوالدين فقط، بل هي واجبة على الدولة والمجتمع في حال عجز الوالدين عن توفيرها للطفل.
|b This study aimed to explain the child’s rights related to civil rights recognized by the Islamic law in the Holy Qur’an and the Sunnah of the Prophet, and to recognize the rights mentioned in the international agreements and conventions in our time that preceded Islam’s approval. Descriptive methods were followed in studying and explaining children’s rights in Islam. This study reviewed the concept of childhood, its stages, and the rights of the child since his birth. At the end of this research, it reached results, the most important of which are: The Islamic law guarantees the child full rights, whether he has a father, an orphan, or a foundling. The study examines the diverse living circumstances whether normal or armed conflict circumstances, and whether the child male or female. This study showed that the rights of the child in Islam are not obligatory for the father only, but rather for the state and society in the event that the father is unable to provide these rights for his child.
