المستخلص: إن من أهم ثمرات علم أصول الفقه هو الإفادة من قواعده في تفسير النصوص القرآنية، ومعرفة الأحكام الفرعية العملية، والكشف عن علل الأحكام ومقاصدها وإعطاء المجتهدين مساحة واسعة لتحويل النصوص القرآنية إلى مجال واسع ورحب للإحاطة بالمستجدات الفقهية، وإيجاد الحلول للنوازل العصرية، والإسهام في رفع الحرج والمشقة عن العباد، ومن ثمراته إثبات كون الشريعة الإسلامية ملائمة لكل زمان ومكان، وقد كون علم أصول الفقه سياجا منيعا بتلك الضوابط والقواعد الأصولية التي فتحت الباب أمام المجتهدين ووسعت أفق الاستنباط لهم وساهمت في إيضاح الرؤية القرآنية لتحقيق مقاصد الشرع من إيجاد الحلول الملائمة للنوازل والمستجدات، وأغلقت الباب أمام المنحرفين الذين يريدون التلاعب بمعاني النص القرآني ولي عنقه لمصالحهم الدنيوية. ولكي لا تكون البحوث القرآنية بعيدة عن الواقع العملي للنص القرآني، ولا تكون مجرد نظريات تسود بها الصفحات، فقد جعلت بحثي في بيان قاعدة استنباط أصولية وهي- لحن الخطاب- أي مفهوم الخطاب وروحه وعمق دلالته، وبينت المراد من هذا المصطلح الأصولي من إيضاح لماهيته ودلالته وحجيته وأصله، ثم اتبعت ذلك بدراسة تطبيقية في القرآن الكريم في محاولة لإيضاح واقعية القاعدة الأصولية، وكيفية الاستفادة منها في فهم دلالة النص من حيث دلالة المنطوق به للمسكوت عنه، واستخراج أحكام عملية جديدة من روح النص ودلالته.

One of the most important fruits of the science of the principles of jurisprudence is benefiting from its rules in interpreting the Qur’anic texts, knowing the practical sub-rulings, revealing the reasons for the rulings and their purposes, and giving the diligent scholars a wide space to transform the Qur’anic texts into a wide and welcoming field to take note of the jurisprudential developments, and find solutions to modern emerging issues, and contribute to alleviating embarrassment. And hardship on behalf of the servants, and among its fruits is proof that Islamic law is appropriate for every time and place, and the science of the principles of jurisprudence has been an impregnable fence with those fundamentalist controls and rules that opened the door for the mujtahids and expanded the horizon of deduction for them and contributed to clarifying the Qur’anic vision to achieve the purposes of the law by finding appropriate solutions to calamities and developments, And it closed the door to deviants who want to manipulate the meanings of the Qur’anic text and twist its neck for their worldly interests. In order for the Qur’anic research not to be far from the practical reality of the Qur’anic text, and not to be mere theories that dominate the pages, I made my research in the statement of a fundamentalist elicitation rule, which is- the melody of discourse- that is, the concept of the discourse, its spirit and the depth of its significance, and I explained the meaning of this fundamentalist term in terms of clarifying its nature and significance. And its authoritativeness and origin, then I followed that with an applied study in the Holy Qur’an in an attempt to clarify the reality of the fundamentalist rule, and how to benefit from it in understanding the significance of the text in terms of the significance of the utterance of what is silent about it, and extracting new practical provisions from the spirit and significance of the text.
