|a إن شروط وإجراءات وشطب وتعديل القيد في السجل التجاري عندما تكون البيانات المسجلة في السجل قد جرى عليها تغيير أو لم يعد هنالك فائدة من وجودها. فإنه لا يبقى هنالك فائدة من هذه البيانات إذا توفي التاجر أو إذا اعتزل التجارة وكذلك الحال بالنسبة للشركة إذا انحلت وتمت تصفيتها في شركة أخرى، كما إن الشخص الطبيعي يعد تاجرا حين يباشر أعمالاً تجارية ويتخذها مهنة معتادة له، وكذلك الشركات التجارية التي يتم قيدها في السجل التجاري، وأن عدم التسجيل يمنع التاجر الغير مسجل أن يتمسك بهذه الصفة إزاء الغير، ولهاذا ارتأينا تقسيم هذا البحث إلى: المبحث الأول: شروط وإجراءات القيد في السجل التجاري المبحث الثاني: شطب وتعديل القيد في السجل التجاري
|b The commercial register is considered one of the most important concepts that are related to commercial law and plays an important role in supporting trust and credit. Several jurisprudential and legal definitions have been mentioned about this concept that have tried to encompass it and the role and functions assigned to it, represented in the informational, statistical and legal advertising functions, among which the legal importance and characteristics that it has make it clear. In line with the development carried out by all legislations, a distinction must also be made between the traditional commercial register and the electronic commercial register, and accordingly, we will address in this research in three sections, in the first topic the functions of the commercial register, and in the second topic the importance and characteristics of the commercial register, and in the third topic we discuss The difference between the traditional commercial register and the electronic commercial register, as follows: The first topic: the functions of the commercial register. The second topic: the importance and characteristics of the commercial register. The third topic: the difference between the traditional commercial register and the electronic commercial register.
