المستخلص: لاشك أن مسؤولية المحامي المدنية لا تحول دون مسائلته جنائيا عن إضراره بمصالح الموكل، وهذا الواجب يقوم من خلال رسمه لخطة دفاعه، وأن يدافع عن موكله وفقا لما يقدمه إليه الموكل من وثائق ومعلومات ومستندات وفقا للأصول العلمية وليس وفق علمه الشخصي. ولعل على رأس هذه المسئوليات التزامه بعدم إفشاء أسرار الموكل ولا شك أن العلاقات التي تربط المحامي بعميله تؤدي إلى ارتفاع واجبات المحامي، وتؤدي إلى اتساع نطاق مسؤوليته عن أخطاءه المهنية مما يؤثر في تحديد ما يكون مسئولا عنه مدنيا وجنائيا.
