المستخلص: تم استحداث آلية التحقيق العقاري نظرا للتأخر الكبير الذي عرفته عملية المسح العام للأراضي وكذا النقائص الجوهرية التي خلفها العمل بعقد الشهرة المنصوص عليه في المرسوم رقم 83-352 المؤرخ في 21 ماي 1983. مما دفع بالمشرع الجزائري إلى إلغاء أحكام عقد الشهرة واستبداله بالقانون رقم 07-02 المؤرخ في 27 فيفري 2007 المتضمن تأسيس إجراء لمعاينة حق الملكية العقارية وتسليم سندات الملكية عن طريق تحقيق عقاري، الذي يتم بالموازاة مع عمليات إعداد مسح الأراضي العام والترقيم في السجل العقاري وبصفة مستقلة عنهما.

L’instauration de l’enquête foncière est due aux lenteurs observées dans l’avancement du cadastre général, et aux insuffisances, au manque de fiabilité et parfois même à l’utilisation abusive de la procédure prévue par le décret n° 83-352 du 21 mai 1983. Ce qui a incité le législateur algérien à abroger les dispositions du décret n° 83 352 et de les remplacé par la loi n° 07-02 du 27 février 2007 portant institution d’une procédure de constatation du droit de propriété immobilière et de délivrance de titres de propriété par voie d’enquête foncière. cette procédure ne se confond pas avec le cadastre général et se fait en parallèle avec lui et avec l’immatriculation au Livre foncier.

The introduction of the real estate investigation mechanism was prompted by significant delays in the general land survey process and fundamental shortcomings arising from the implementation of the goodwill contract outlined in Decree No. 83-352 dated May 21, 1983. In response, the Algerian legislator decided to annul the provisions of the goodwill contract and replace it with Law No. 07-02 dated February 27, 2007. This law establishes a procedure for inspecting the right to real estate ownership and facilitating the transfer of title deeds through a real estate investigation. Notably, this investigation runs parallel to, and independently of, the processes involved in preparing the general land survey and numbering in the real estate registry.
