المستخلص: يعتبر الحق في الصورة من أهم عناصر الحياة الخاصة، وبما أن الصورة ترتبط بشخص الإنسان ارتباطا وثيقا يجعل منها ذات قيمة تفرض ضرورة حمايتها خصوصا في ظل التطورات التكنولوجية الحديثة، وقد تدخلت جل التشريعات لحماية هذا الحق بتجريم الاعتداء عليه وحصر كل فعل يشكل مساسا بالحق في الصورة من جهة، ووضع حدود وضوابط لأعمال السلطة القضائية أثناء استعمالها لصلاحية التقاط الصورة عن طريق الإذن، وحصر الجرائم المعنية بهذا الإجراء، وكذا تحديد الأشخاص الذين يملكون صلاحية ذلك من جهة أخرى.

Le droit à l'image des éléments les plus importants de la vie privée, et que les images se rapportent à la personne humaine est intrinsèquement liée donc la valeur et la nécessité de les protéger, en particulier à la lumière des récents développements technologiques, la plupart des législations ont intervenu pour protéger ce droit et criminaliser l'agression et toute violation du droit à l'image d'une part, la fixation de limites et contrôle le travail de la justice pendant la durée de leur utilisation pour la capture d'image avec l'autorisation, et d'innombrables crimes impliqués dans cette procédure, ainsi que pour identifier les personnes qui ont le pouvoir à elle d'autre part.

The right to one's image is considered one of the most crucial aspects of private life. Given the close connection between the image and the individual, its intrinsic value necessitates protection, particularly in the context of modern technological advancements. Legislation across various jurisdictions has intervened to safeguard this right by criminalizing any infringement upon it. Acts that violate the right to one's photo are restricted, and legal frameworks are established to delineate boundaries and controls for judicial authorities when exercising the power to capture images with permission. Additionally, there are limitations on the crimes associated with this process, and specific individuals are identified as having the authority to engage in such actions.
