المستخلص: تهدف هذه الدراسة إلى محاولة إدراك وعرض الوضعية القانونية الحقيقية للقابلة، ودور النصوص القانونية في علاقتها بإنجاز المهام الموكلة إليها والعمل على تحقيق الحماية لها، وتعريفها بأبرز الأطر القانونية التي يتوجب عليها معرفتها قبل وبعد ممارستها لمهنة المخاطر، ثم محاولة معرفة ما إذا كانت هذه القوانين الموجودة ستشكل حافزا لها لإعطاء الأفضل بدل أن تكون هاجسا لأكبر مخاوفها.

Le but de cette étude est de comprendre et de présenter le statut juridique réel de la sage-femme et le rôle des textes juridiques dans leur relation avec l'accomplissement des tâches qui lui sont confiées et d'oeuvrer pour la protection et la définition des cadres juridiques qu'elle doit connaître avant et après l'exercice de la profession. Ensuite, essayez de comprendre si ces lois existantes seront une incitation pour donner de leur meilleur au lieu d'être une préoccupation qui représente sa plus grande peurs.

This study aims to attempt to understand and present the true legal status of the midwife, as well as the role of legal texts in her relationship to accomplishing the tasks entrusted to her and working towards achieving protection. It also seeks to introduce her to the most prominent legal frameworks she must be familiar with before and after practising this risky profession. Subsequently, we will explore whether these existing laws serve as an incentive for her to give her best rather than becoming a source of her greatest fears.
