المستخلص: نرصد من خلال هذه الورقة البحثية إشكالية تطبيق مبدأ السلطة الرئاسية في التنظيم الإداري الجزائري، لاسيما فكرة الجمع بين المركزية الإدارية واللامركزية، كذلك التطرق إلى مدى أهمية وجود سلطة رئاسية قوية فاعلة قانونية مطبقة على أرض الواقع، وفق شرعية ومشروعية دائمة. فالسلطة الرئاسية لها دور كبير في المساهمة في تحقيق التنمية المستدامة والحوكمة الإدارية، وقد اعتمدنا على منهجية علمية بداية بتحديد مفاهيم التنظيم الإداري ومبدأ السلطة الرئاسية، ثم تفصيل الموقف الفقهي الجزائري من مبدأ السلطة الرئاسية وكيفية تفادي وتضارب المقاربة النظرية والواقع، ومن أهم نتائج الدراسة ما يلي: 1- السلطة الرئاسية المستندة إلى القانون تمثل الدرع الواقي للأمة، إذ يعود لها الفضل في حفظ وتقوية جميع مؤسسات الدولة وحمايتها من خطر الفرقة والشتات. 2. القانون الجزائري يعطي هامشا واسعا للسلطة الرئاسية في تنفيذ قرارات وقوانين الدولة. 3 ـ وجود بعض الممارسات غير المشروعة كالتعسف في استعمال السلطة الرئاسية إلا أن علاجها يبقى الحل الأمثل للعودة إلى الطريق الصحيح. 4. حتمية التفكير في تطبيق قاعدة الجمع بين المركزية واللامركزية التي أضحت أكثر من ضرورة نظرا لكثرة المشاكل والتعقيدات التي صادفت التطبيقات اللامركزية، وسد كل الثغرات، لاسيما مسألة خطر إحياء النعرات الجهوية والقبلية والعشائرية.. الخ.

In this paper we examine the problem of applying the principle of presidential authority in the Algerian administrative organization, especially the idea of combining administrative centralization with decentralization. It also discusses the importance of a strong and effective presidential authority in practice. Presidential authority has a major role in contributing to the achievement of sustainable development and governance. To analyze this problem and answer it, we have adopted a knowledge approach that combines the legal and political approach beginning with defining the concepts of administrative organization and the principle of presidential authority. Indeed. he question of following the state to the pattern of horizontal power has posed a threat to the unity of the country and the people. Therefore, the choice of vertical power at that stage was the best solution, especially for some peoples and communities, so that the security and integrity of its territorial integrity and territorial borders would be preserved. Where the unity of all parties and movements and dissolved in the crucible of one party and one army and one leadership, so as not to multiply opinions and diverge the word, which we will try to clarify through the issue of presidential power, which raises the issue of renewed: How can the theory of presidential power contribute to the power of the central and decentralized administrative organization? The main findings of the study are: 1 The presidential power based on the law represents the protective shield of the nation, as it is credited with preserving and strengthening all state institutions and protecting them from the danger of division and dispersal. 2 Algerian law gives a broad margin to the presidential authority in the implementation of the decisions and laws of the state, but remains the desired goal and the highest is to establish legitimacy and uphold the rule of law on all authorities. 3. The existence of some illegal practices such as abuse of presidential power, but treatment remains the best solution to return to the right path. 4. The necessity of thinking about applying the rule of combining centralization and decentralization, which has become more than necessary due to the many problems and complexities encountered in decentralized applications, and filling all gaps, especially the issue of the danger of reviving regional, ethnic, tribal and other strife.

Dans cet article, nous examinons le problème de l’application du principe de l’autorité présidentielle dans l’organisation administrative algérienne, en particulier l’idée de combiner centralisation et décentralisation administratives, ainsi que l’importance d’une autorité présidentielle forte, effective et effective sur le terrain. L’autorité présidentielle a un rôle majeur à jouer dans la réalisation du développement durable et de la gouvernance administrative: nous avons adopté une méthodologie scientifique commençant par la définition des concepts d’organisation administrative et du principe de l’autorité présidentielle, puis par l’élaboration de la position jurisprudentielle de l’Algérie sur le principe de l’autorité présidentielle. Les principales conclusions de l'étude sont les suivantes: Le pouvoir présidentiel fondé sur la loi représente le bouclier protecteur de la nation, car il est crédité de la préservation et du renforcement de toutes les institutions de l’État et de leur protection contre le danger de division et de dispersion. 2 Le droit algérien donne une large marge de manoeuvre à l'autorité présidentielle dans la mise en oeuvre des décisions et des lois de l'État. 3. L’existence de certaines pratiques illégales telles que l’abus du pouvoir présidentiel, mais le traitement reste la meilleure solution pour revenir sur la bonne voie. 4. La nécessité de réfléchir à l'application de la règle consistant à combiner la centralisation et la décentralisation, qui est devenue plus que nécessaire en raison des nombreux problèmes et complexités rencontrés dans les applications décentralisées, et pour combler toutes les lacunes, en particulier le risque de revitalisation des conflits régionaux.
