المستخلص: يعد مبدأ استقلالية القضاء الإداري من الدعائم الأساسية التي كرسها المشرع الجزائري لحماية وصون حقوق الإنسان وحرياته وتكريس مبدأ المشروعية في مواجهة تعسف وطغيان الإدارة. ولتعزيز وتدعيم هذا المبدأ لا بد له من ضمانات تعمل على تطبيق المبدأ فعليا، لهذا تسعى الدساتير والقوانين في مختلف الدول إلى تحصين هذا المبدأ بمجموعة من الضمانات تجعل من القاضي الإداري قاض قويا يسعى إلى بناء دولة القانون وحماية حقوق الأفراد وحرياتهم وبالرجوع إلى الدستور والقوانين الجزائرية نجد أن المشرع كرس مجموعة من الضمانات لحماية مبدأ استقلالية القضاء الإداري وجعله ضمانة كبرى لتكريس القاعدة القانونية وإعلاء علو القانون في المجتمع.

The principle of the independence of the administrative judiciary is one of the main pillars that the Algerian legislator has devoted to protecting and safeguarding human rights and freedoms and dedicating the principle of legitimacy to confronting the arbitrariness and tyranny of the administration. To reinforce and support this principle, it must have guarantees working to implement the principle effectively. That is why constitutions and laws in various countries seek to fortify this principle with a set of guarantees that make the administrative judge a strong judge seeking to build a state of law and protect individuals ’rights and freedoms. By referring to the constitution and Algerian laws, we find The legislator has devoted a set of guarantees to protect the principle of the independence of the administrative judiciary, and to make it a major guarantee to establish the legal rule and raise the rule of law in society.
