|a تحاول هذه الورقة تسليط الضوء على واقع المصارف الإسلامية في ليبيا، وذلك بدراسة منتج المرابحة للأمر بالشراء باعتباره معتمدا لها في التعامل مع بيان حقيقته، والنهج الذي انتهجته المصارف بشأنه، ثم بيان حكم الشرع فيه، والذي يصل إلى حد المنع. وحتى لا نتهم بالتضييق على الناس في معاملاتهم، قمنا بفتح آفاق أخر أمام هذه المصارف، بتوجيه استثماراتها صوب قطاع الزراعة - عن طريق منتج السلم - والتي من شأنها أن تحقق استقرارا وأمنا غذائيا، علاوة على أرباح مضمونة التحقيق. كما سعت الورقة إلى الدفع بالمصارف الإسلامية لاستثمار مدخراتها في المجال العقاري، وخصوصا عقار السكنى، على ما في ذلك من منافع للمصارف وللمجتمع، يغني عهد الذهن بها عن التصريح.
|b This paper attempts to shed light on the reality of Islamic banks in Libya, by studying the Murabaha product for the purchase orderer as it is approved for them in dealing, with a statement of its truth, and the approach taken by the banks in this regard, and then a statement of the Sharia ruling in it, which reaches the point of prohibition. In order not to be accused of restricting people in their dealings, we have opened other horizons for these banks, directing their investments towards the agricultural sector- through the Alsalm- which would achieve stability and food security, in addition to guaranteed profits. The paper also sought to push Islamic banks to invest their savings in the real estate field, especially residential real estate, in view of the benefits that this brings to banks and society, the era of which the mind sings without declaring
