|a يعرض هذا البحث مفهوم العدل ومظاهره في آداب القاضي مع الخصوم من خلال دراسة فقهية ومقاصدية للمسائل والمفاهيم المتعلقة بالموضوع. وقد استعرض الباحث مكانة العدل في المقاصد الضرورية للشريعة عموما وفي القضاء خصوصا، وتتبع المسائل الفقهية التي ترسخ مقصد العدل في آداب القاضي مع الخصوم، سواء قبل المرافعة أو أثناءها أو بعدها. اتبع الباحث المنهج الوصفي التحليلي في دراسته، وتم إعداد البحث للقضاة على وجه الخصوص ومن في حكمهم من محامين ومصلحين ومحكمين وغيرهم ممن يتوسط في الإصلاح وفض المنازعات بين الناس؛ تذكيرا لهم بجعل العدل نصب أعينهم فيما يتولونه من عمل، وتقريبا للمسائل المتعلقة بالموضوع إليهم. وختم البحث بما توصل إليه الباحث من نتائج وتوصيات.
|b This paper aims at examining the manifestations of justice in the ethics of the Judge towards the parties to litigations in the Islamic jurisprudence with appraisal from both jurisprudential and Maqāṣid (objectives of Islamic law) perspectives, purposely to illuminate the fairness of judiciary in Islam, and to reiterate the fact that justice is one of the most significant objectives that the Sharī’ah aims at achieving in the judiciary. Hence, it is incumbent upon the Judge to always consider this in their judicial exercise, such that it would never be compromised for any reason. The research concluded with certain findings, including: that justice is the bedrock for the ethics mentioned by the jurists for the Judge towards the parties to litigation, and that justice is absolutely mandatory in the judiciary, always, against all persons without prejudice, and for all persons without prejudice.
