المستخلص: تهدف هذه الدراسة إلى تحديد مفهوم الاستشارات القانونية، وبيان أهميتها، وإلقاء الضوء على أنواعها، ومعرفة المخولين بتقديمها، والإلمام بالآليات التقليدية والحديثة في تقديم المشورة القانونية، كما تستعرض بعض مناهج تقديم الاستشارات القانونية، والتعريف بالنظم الخبيرة القانونية باعتبارها أحد آليات تقديمها، وتطرق لتمييز عقد الاستشارة القانونية عن غيره من العقود المشابهة، وبيان تأثير جائحة كورونا على عقد الاستشارة القانونية وآليات تقديمها، ومن أجل تحقيق أهداف البحث انتهجت الباحثة المنهج الوصفي والتحليلي في تنفيذ الدراسة، وتتمحور المشكلة حول تعدد آليات وأشكال تقديم الاستشارات القانونية في ظل جائحة كورونا بالمدينة المنورة، حيث أصبح المستشارون القانونيون في سباق إلى تغيير الأساليب والآليات التي يستخدمونها في تقديمها؛ مواكبة للأوضاع السائدة للمحافظة على مهنتهم؛ مما سبب اختلاف رأي المستفيدين لما اعتادوا عليه من طريقة تقليدية، وغدت الوسائل كثيرة، وأصبحت مصدر تشتيت وتشكيك عند المستفيدين بالمدينة المنورة ، وقد رأت الباحثة ضرورة حصرها وتعدادها وتوضيحها، لذا كان التساؤل الرئيس: ما هي آليات تقديم الاستشارات القانونية في ظل جائحة كورونا (COVID-19) بالمدينة المنورة؟ وبعد قيام الباحثة بتحليل الموضوع ودراسته، اتضح ازدياد عدد الآليات المستخدمة في تقديم الاستشارة القانونية بعد جائحة كورونا، وأن أهم الآثار الإيجابية لجائحة كورونا على تقديم الاستشارات القانونية هو إمكانية تقديمها في أي زمان ومكان، لذا يوصي المنظم السعودي بإصدار نظام قانوني يتناول أحكام عقد المشورة القانونية، ويحدد طبيعته والتزامات أطرافه، ومفهوم المستشار القانوني وشروط ترخيصه بشكل صريح وقاطع للخلاف، كما يوصي المنظم بتعيين جهة مختصة لتوثيق واعتماد وحصر آليات تقديم الاستشارة القانونية الإلكترونية؛ منعا للاحتيال، وتقنين إعمال الأنظمة الخبيرة القانونية كآلية لمساندة المستشار القانوني في عمله.

This study aims at defining the concept of legal consultancy, explicate its importance, shed light on its types, identifying those who are authorized to offer it, and getting acquainted with the traditional and modern mechanisms of offering legal consultancy, as well as reviewing some approaches to offering legal consultancy, and the introduction of legal expert laws as one of its mechanisms, and the research addressed the distinction between the legal consultancy contract and other similar contracts, and it showed the impact of the Corona virus pandemic on the legal consultancy contract and the mechanisms through which it is offered. In order to achieve the objectives of the research, the researcher adopted the descriptive and analytical methodologies in conducting the study. The research problem revolves around the multiplicity of mechanisms and forms of offering legal consultancy in light of the Corona virus pandemic in Medina, where legal consultants/advisors were competing to upgrade the methods and mechanisms they use in doing their job, in keeping pace with the prevailing conditions so they can preserve their profession, which caused the difference of opinion among the beneficiaries because of what they were accustomed to in from the traditional method, hence, a variety of means surfaced, and this triggered distraction and skepticism among the beneficiaries in Medina. The researcher deemed it pertinent to count, enumerate and clarify the mechanisms which led to the main question of the research which is: What are the mechanisms for offering legal consultancy in light of the Corona virus pandemic (COVID-19) in Madinah? After the researcher analyzed and studied the topic, it became apparent that the number of mechanisms used in offering legal consultancy increased after the Corona virus pandemic, and that the most important positive effects of the Corona virus pandemic on the legal consultancy service is the possibility of offering it at any time and place. Based on this, it was recommended that the Saudi regulator issues a law that will address the provisions of the legal consultancy contract, and clarify its nature and the obligations of its parties, and the concept of legal consultant/ advisor and the conditions for their licensing explicitly and categorically, and it was also recommended that the regulator specifies a competent authority that for the documentation, approval and the inventory of the mechanisms for offering electronic legal consultancy, in order to prevent fraud, and to legalize the implementation of legal expert law as a mechanism to support the legal consultant/advisor in their work.
