|a يهدف هذا البحث "مفهوم الشرعية ومعاييرها في الفقه السياسي الإسلامي" إلى بيان مقومات الشرعية ومعاييرها التي تحفظ للدولة استقرارها واستمرارها، كما يهدف إلى بيان السبب في احتماء الحكومات بالشرعية في مواجهة معارضيها، ويقوم منهج الدراسة على المنهجين: الوصفي والاستقرائي التحليلي، والحرص على تدعيم البحث بالنصوص الشرعية كلما لزم، وذلك من خلال ثلاثة مباحث؛ عرض المبحث الأول مفهوم الشرعية وأهميتها، بينما اهتم المبحث الثاني ببيان النظريات الغربية للشرعية والمنظور الإسلامي لها، أما البحث الأخير فقد تعرض لمعايير الشرعية وأزماتها. وكان من نتائج البحث: أن عدم الاستقرار السياسي في الوطن العربي هو نتيجة غياب الحياة السياسية السليمة، ومن أهم توصياته ضرورة إعطاء مفهوم الشرعية حقه بالتوضيح والتمييز عن غيره من المفاهيم وبناء سياسات دولية من خلال الإطار الشرعي الإسلامي فلا تفقد الدولة هويتها في سيرها بركب العالمية.
|b This research, “The Concept of Legitimacy and Its Standards in Islamic Political Jurisprudence,” aims to explain the components of legitimacy and its standards that preserve the stability and continuity of the state. It also aims to explain the reason why governments seek refuge in legitimacy in the face of their opponents. The study is based on two methodologies: the descriptive and inductive analytical approaches. Additionally, the study is keen on reinforcing the research with Islamic legal texts whenever necessary. This is achieved through three sections; the first section presents the concept of legitimacy and its importance, while the second section focuses on explaining Western theories of legitimacy and the Islamic perspective on them. The final part of the research addresses the standards of legitimacy and its crises. One of the research findings was that the political instability in the Arab world is a result of the absence of a sound political life. One of its crucial recommendations is the necessity to clarify and distinguish the concept of legitimacy from other concepts. Moreover, it emphasizes the importance of constructing international policies within the framework of Islamic jurisprudence, ensuring that the state does not lose its identity while participating in global affairs.
