تتجلى أهمية الموضوع قيد الدراسة في بيان أهمية توثيق هذا النوع من البيوع وإبراز ضمانات تنفيذه، لما لهو من الاستثمار الاقتصادي وإنعاش الاقتصاد الوطني وتحقيق التنمية المجالية، إضافة إلى تشجيع المنافسة الحرة والشريفة في القطاع العقاري. واعتباره حلا بديلا للطبقة المتوسطة في المجتمع وأصحاب الدخل المحدود من أجل اقتناء سكن لائق وبدفع أقساط تتناسب مع الوضع الاجتماعي، إضافة إلى حل مشاكل التشرد في الشوارع وتشجيع الشباب على مثل هذه التصرفات من شأنه أن يقلص من حدة البطالة. بناء على ما ذكر ينطوي البحث على إشكالية مفادها: مدى توفق المشرع المغربي من خلال قانون 12 107 في إيجاد حلول للتجاوزات المتعلقة بتوثيق بيع العقارات على التصاميم، مع مراعاة مصالح الطرفين بين تحديد الضمانات للبائع المنجز والمشتري المنجز لفائدته. بالإضافة إلى قدرة الضمانات المخولة للمشتري في حماية مصالحه.
The importance of the subject under study lies in highlighting the significance of documenting this type of real estate transaction and emphasizing the guarantees for its implementation. This plays a role in encouraging economic investment, revitalizing the national economy, achieving regional development, and promoting fair competition in the real estate sector. It is also considered an alternative solution for the middle class and those with limited income to acquire decent housing with installments that align with their social situation. Additionally, it addresses the issue of homelessness, and encourages youth to engage in such transactions, potentially reducing unemployment. Based on the above, the research poses the problem: To what extent has the Moroccan legislator, through Law 12 107, succeeded in finding solutions to the challenges related to documenting selling real estate under construction, considering the interests of both the seller and the buyer in terms of specifying guarantees for the seller who is constructing and buyer whom it is constructed for.
