المستخلص: هدفت الدراسة إلى معرفة دور الاختصاصي النفسي في تحديد المسؤولية الجنائية كما يدركه أعضاء الهيئة القضائية بالمحاكم الليبية ومعرفة الفروق في إدراك هذا الدور تبعا لمتغير نوع وظيفة أعضاء الهيئة القضائية (قاضي- وكيل نيابة) وكذلك تبعا لمتغير سنوات الخبرة لأعضاء الهيئة القضائية، تكونت عينة الدراسة من (60) فرد بواقع (28) قاضيا، و(32) وكيل نيابة، تم اختيارها بطريقة العينة العرضية، استخدم الباحث المنهج الوصفي، ومقياس دور الاختصاصي النفسي في تحديد المسؤولية الجنائية للمريض النفسي: (أعداد الباحث)، وتم استخدام الحزمة الإحصائية للعلوم الاجتماعية (SPSS)، حيث أوضحت نتائج الدراسة أن إدراك أعضاء الهيئة القضائية لدور الاختصاصي النفسي في تحديد المسؤولية الجنائية يتسم بالارتفاع، وكذلك توجد فروق دالة إحصائيا بين أعضاء الهيئة القضائية في درجاتهم على أداة الدراسة تبعا لاختلاف نوع الوظيفة (قاضي- وكيل نيابة) وكان اتجاه الفروق لصالح القضاة. كذلك توجد فروق دالة إحصائيا بين أعضاء الهيئة القضائية (قاضي- وكيل نيابة) في درجاتهم على أداة الدراسة تبعا لاختلاف سنوات الخبرة وكان اتجاه الفروق لصالح كثيري الخبرة.

The study aimed to know the role of the psychologist in determining criminal responsibility as perceived by members of the judicial body in the Libyan courts, and to know the differences in perception of this role according to the variable type of job of the members of the judicial body (judge - prosecutor), as well as according to the variable years of experience of the members of the judicial body. The study sample consisted of (60 individuals, including (28) judges and (32) prosecutors, selected using a cross-sampling method. The researcher used the descriptive approach and a measure of the role of the psychologist in determining the criminal responsibility of the psychiatric patient: (numbers by the researcher), and the statistical package for the social sciences was used ( SPSS), as the results of the study showed that the awareness of members of the judiciary of the role of the psychologist in determining criminal responsibility is high, and there are also statistically significant differences between members of the judiciary in their scores on the study tool according to the difference in the type of job (judge - prosecutor), and the direction of the differences was in favor Judges. There are also statistically significant differences between members of the judiciary (judge - prosecutor) in their scores on the study tool according to the difference in years of experience, and the direction of the differences was in favor of those with great experience.
