|a يعتبر الحق في الصحة من الحقوق الأساسية للإنسان المعترف بها بموجب مختلف النصوص الدولية والوطنية، لارتباطه بحق أساسي يتعلق باستمرارية البشرية ألا وهو الحق في الحياة، غير أن تحقق التمتع الأقصى به للأفراد قد يتطلب توفر عدة عوامل منها ما يتعلق بقدرة الدولة على ضمان وجود بيئة آمنة تضمن تمكين الأفراد من الرفاه الجسدي، والنفسي والاجتماعي الكامل الذي يتحقق معه تمتعهم بأعلى مستوى من الصحة الجسمية والعقلية يمكن بلوغه، من خلال توفير كل الإمكانيات والوسائل الخاصة بالرعاية الصحية ومنع انتشار الأمراض وظهور الأوبئة. غير أن الوصول لهذه الغايات قد يصطدم بموجة التغيرات المناخية التي أصابت الأرض وأصبحت تزيد حدتها يوما بعد يوم في ظل نهج تصاعدي امتدت آثاره لكل دول العالم، ما يشكل تهديدا حقيقيا لاستمرارية الحياة البشرية واستقرارها. من خلال هذه الدراسة سنحاول إلقاء الضوء على أهم التحديات التي تواجه الدول في حماية حق أفرادها في الصحة بسبب التغير المناخي والوقوف على أهم المشاكل التي قد تعيق ذلك.
|b The right to health is considered one of the basic human rights recognized under various international and national texts, because it is linked to a fundamental right related to the continuity of humanity, which is the right to life. However, achieving the maximum enjoyment of it for individuals may require the availability of several factors, including those related to the ability of the state to ensure a safe environment, Ensuring that individuals are empowered with full physical, psychological and social well-being, which achieves their enjoyment of the highest attainable level of physical and mental health, by providing all possibilities and means for health care and preventing the spread of diseases and the emergence of epidemics. But, to reach these ends may collide with the wave of climatic changes that hit the planet and is becoming more intense day after day in light of an upward approach whose effects extended to all countries of the world, which constitutes a real threat to the continuity and stability of human life. Through this study, we will try to shed light on the most important challenges that countries face in protecting the right of their people to health due to climate change, and to identify the most important problems that may hinder this.
