|a هذا البحث يستهدف تأصيل الاستدلال بالاستقراء، وبيان مدى أثره وإسهامه في إثبات مقاصد الشريعة عند الأصوليين؛ إذ اعتمد عليه الأصوليون في تأصيل القواعد والمسائل الأصولية وتأسيسها، ثم إن الاستقراء يعد لبنة من لبنات الفكر المقاصدي، ودليلا من أدلة إثبات مقاصد الشريعة لديهم؛ إذ وظفوه في الاستدلال على التعليل، والتقصيد، والتقعيد، والترتيب، والترجيح المقاصدي، وبذلك كون الاستقراء لديهم ملكة مقاصدية فريدة. وقد توصل هذا البحث إلى نتائج، أهمها: -إن الاستقراء -بنوعيه التام والناقص -حجة في الفكر الأصولي، ودليل من أدلة إثبات المقاصد الشرعية. -إن الشريعة الإسلامية جاءت لتحقيق مصالح العباد في المعاش والمعاد، وهذه النتيجة توصل إليها الأصوليون بالاستقراء. -إن للاستقراء أثرا بالغا في إثبات مقاصد الشريعة تعليلا وتقصيدا، وتقعيدا وتفريعا، وترتيبا وترجيحا واستدلالا. -إن استقراء نصوص الشريعة الإسلامية وأدلتها الكلية والجزئية -قرآنا وسنة -يسهم في تجديد الاجتهاد المقاصدي، واستنباط الأحكام الشرعية، وتوفير الحلول للمشكلات الطارئة والنوازل المستجدة.
|b This study aims at deriving inference by inductive reasoning and manifesting the extent of its impact and contribution in proving Sharia intents among fundamentalists as they relied on it to derive and establish rules and issues of fundamentalism. Induction is also considered a building block of their thought in terms of intents and proof among the evidence that substantiate the intents of Sharia according to them. For they applied it to infer reasoning, manifestation of intents, rules generating, arrangement, and preponderance of intents, and to this end, made a unique talent of in terms of intents. This research has reached the following results: -Both types of inductive reasoning- comprehensive and partial is an argument in the fundamentalist thought and evidence that prove Sharia intents. -The Islamic law came to achieve the interests of the people in this life and the hereafter life, and this result has been reached at by the fundamentalists through induction. -Inductive reasoning has a profound impact in the areas that substantiate Sharia purposes in terms of reasoning, manifestation of intents, rules generating, coordinating, arrangement, preponderance, and inference. -The use of inductive reasoning in the texts of Islamic law and its comprehensive and partial evidence from the Qur'an and the Sunnah contributes to revitalizing purposeful judgment, deriving legal rulings and providing solutions to emerging problems and new challenges.
