إن الحديث عن العقد، يعنى الحديث عن المستند الورقي الذي يجسد اتفاق الأطراف، والمتضمن في نهايته التوقيع اليدوي أو الخطى. لكن نظرًا لانتشار وسائل الاتصال في السنوات الأخيرة وظهور الحاجة إلى سرعة التعاقد وبأكثر فعالية، كان لابد من البحث عن البديل للكتابة المتضمنة لاتفاق الإرادات. وعليه فالمشرع الجزائري وفي تعديله للقانون المدني بالأمر 05/ 1. المؤرخ في 2./06/2005 قد أعطى نفس الحجية في الإثبات للكتابة الالكتروني كما في الكتابة على الورق وفقًا للمادة 323 مكرر فقرة 1 ولكن بشروط:- - من جهة يجب أن تحتفظ بطريقة يمكن معها ضمان سلامتها، مما يسمح بإمكانية استرجاعها وقراءتها عند الحاجة. ومن جهة أخري أن يكون بالإمكان التعرف عن الشخص الصادر عنه التوقيع، وإثبات التزامه بالتصرف. \ Jusqu' with very recently , which said contract said support materializing the agreement of flying , paper medium.
