المستخلص: يتعلق العرف والعادة دائما بحياة الناس، وصلة ذلك الوثيقة بعلم الفقه وأصوله؛ فبعض العادات المصرية المتوازنة بين الناس والمجتمعات؛ قد تصبح دليلا تشريعيا في بعض الأحيان وعند ظروف معينة، فتبنى عليه الأحكام وتتغير بتغيره. وقد راعت الشريعة الإسلامية العرف والعادة الجارية بين الناس في التشريع. إذن فالشريعة الإسلامية مرنة، تتسع بنصوصها وأحكامها كل مكان وزمان. وبتسليط الضوء على أثر العرف والعادة في تغير الأحكام الشرعية مراعاة للمقام؛ وجد هذا التأثير ومدى تأثر الأحوال الشخصية بالعرف والعادة، وأيضا مراعاة المقام ومقتضى الحال في العبادات وفي الأحوال الشخصية والمعاملات، فكان لإبرازه أهمية؛ لأنه يسلط الضوء على أثر من آثار الثورة العلمية في مجال غزو الفضاء، ويبين ما يتعلق به من أحكام شرعية، كمواقيت الصلاة والصيام لرواد محطة الفضاء الدولي، وكيفية اتجاه القبلة لهم. فكان لهذا البحث أثر عظيم في الحياة اليومية، حيث إن العرف والعادة لهما أثر كبير في مراعاة المقام ومقتضى الحال في العبادات وفي الأحوال الشخصية والمعاملات مراعاة للمقام وطبيعة الحياة المعاصرة. وبما أن مسائل الأحوال الشخصية تندرج تحت الفقه الإسلامي فقد تأثرت بالعرف بشكل ملحوظ، مما دفعني إلى أن أبرز هذا الأثر في تقديم (قائمة المنقولات) في بحث خاص، وإبراز الجانب الأصولي والتطبيقي؛ حيث إنه الغاية من هذه الدراسة، وكيف كان للعرف أثر كبير على الخلع، وعلى إبرام العقود وكذلك الفتوى عبر وسائل الاتصال المعاصرة.

Custom and habit are always related to people's lives and this is closely related to the science of jurisprudence and its principles. Some Egyptian customs are balanced between people and societies; It may become a legislative guide at times and under certain circumstances and rulings are built on it and change as it changes. Islamic law took into account the custom and custom existing among people in legislation. Therefore, Islamic law is flexible and expands with its texts and rulings in every place and time. By highlighting the impact of custom and habit on changing legal rulings out of respect for status; This influence was found and the extent to which personal statuses are affected by custom and habit, as well as taking into account the status and requirements of the situation in acts of worship and in personal statuses and transactions, was important to highlight. Because it highlights one of the effects of the scientific revolution in the field of space conquest, and explains the legal rulings related to it, such as prayer and fasting times for the astronauts of the International Space Station, and the direction of the Qiblah for them. This research had a great impact on daily life, as custom and habit have a great impact in taking into account the status and the requirements of the situation in worship and in personal status and transactions, taking into account the status and nature of contemporary life. Since personal status issues fall under Islamic jurisprudence, they have been significantly influenced by custom, which prompted me to highlight this influence in presenting (the list of movables) in a special research, and to highlight the fundamental and applied aspect. As it is the purpose of this study, and how custom has had a significant impact on divorce, and on concluding contracts, as well as fatwas through contemporary means of communication. May God make him pure for his honorable face.
