|a يتضمن هذا البحث دراسة التدابير الاحترازية في كل من الشريعة الإسلامية والقوانين الوضعية، وذلك باعتبار أن التدابير نوع آخر من أنواع الجزاء الجنائي إلا أنه يهدف في غالبيته إلى منع وقوع الجريمة، لأنها مجموعة من الإجراءات تتخذ حيال المجرم بهدف مواجهة خطورة إجرامية كامنة في شخص الجاني لتدرأها عن المجتمع، وهي لذلك تكمل النظام القانوني الجنائي وخاصة في الحالات التي لا يمكن أن توقع العقوبة نظرا لعدم توافر شروط المسئولية الجنائية حيال الجاني، كما أنها تكمل العقوبة أيضا في الحالات التي لا تجدي فيها العقوبة في إصلاح المحكوم عليه وتهذيبه، وللتدابير الاحترازية مجال خصب في الشريعة الإسلامية أكثر مما هو معول عليه في التشريعات الوضعية حيث توجد أضرب كثيرة منها وبخاصة ما يسمي بالتدابير الروحية التي تتعلق بالعبادات دون غيرها في إفاقة الجاني وإرجاعه عن مشروعه الإجرامي، عكس القوانين الوضعية التي لا تهتم بتلك الجوانب الروحية، وعليه فإنني أقدمت على دراسة التدابير الاحترازية في كل من الشريعة والقانون.
|b This research includes a study of precautionary measures in both Islamic law and man-made laws, considering that the measures are another type of criminal punishment, but most of them aim to prevent the occurrence of the crime, because it is a group of measures taken towards the criminal with the aim of confronting the criminal danger inherent in the person of the offender in order to avert it. On behalf of society, it therefore complements the criminal legal system, especially in cases where punishment cannot be imposed due to the lack of conditions for criminal responsibility towards the offender. It also complements punishment in cases where punishment is not effective in reforming and refining the convict. Precautionary measures have a fertile field in Sharia law. Islamic law more than what is relied upon in man-made legislation, as there are many types of them, especially what are called spiritual measures that relate to acts of worship alone, in order to revive the offender and turn him back from his criminal project, in contrast to man-made laws that do not care about these spiritual aspects. Accordingly, I began to study precautionary measures in Both Sharia and law.
