• Jurists have agreed that the marriage payment (mahr) has no maximum limit; rather, it can be any amount, no matter how large, as long as both parties agree on it. • The scholarly controversy concerns the minimum amount of marriage payment. The Shafi’is and Hanbalis hold that there is no limit to the minimum marriage payment; it is permissible to pay any amount, no matter how little. According to them, it is also permissible to pay the marriage payment in any form other than money. • According to Hanafi scholars, the marriage payment is estimated at its minimum according to the Shari’ah, and it is exclusively money. They set its minimum amount at ten dirhams. While the Malikis agree with them, they however set its amount at three dirhams. The paper presents the evidence of the two groups, giving preference to the Hanafi opinion due to the strength of their evidences and the soundness of their inference.
