|a استمرت قضية بنوك الحليب البشري من المسائل الخلافية بين فقهاء المسلمين، وذلك بسبب خلاف الفقهاء في ثبوت حرمة الرضاع التي هي كحرمة النسب، يهدف البحث إلى بيان الآثار والأحكام الشرعية المتعلقة بوجود بنوك الحليب في بعض الدول التي فيها أقلية من المسلمين، وذلك استنادا على الوصف الدقيق لبنوك الحليب والآليات والإجراءات المتبعة فيها، ويوضح البحث خلاف الفقهاء في المسألة والأدلة التي استندوا عليها، ومناقشة وجه الدلالة لكل قول، مع ذكر المعاني اللغوية للألفاظ التي وقع فيها الخلاف، ثم الترجيح في الحكم استنادا على الآليات والإجراءات المتبعة حاليا في بنوك الحليب، مع ذكر الدليل الصريح من القرآن الكريم في سبب الترجيح.
|b Human milk banks have been a contentious issue in Muslim minority countries. Some Muslims are hesitant to use them because they believe the infant will become related to the milk donor. The issue persists because of incorrect information about milk bank procedures. The purpose of this research is to elucidate the Sharia rulings on human milk banks in countries where Muslims are minority. The study accurately describes human milk banks, defines jurists' disagreements, provides evidence, and then discusses their judgments based on current human milk banks procedures. Based on linguistic and interpretive evidence from the Quran, the study concludes that infants in Muslim minority countries can consume donated milk. The study suggests expanding the milk banks safety procedures to the realm of wet nursing by official means, which satisfies Islamic views of the practice.
