|a تتلخص دراسة موضوع "إدارة الدعوى المدنية" في التعرف على ماهية إدارة هذه الدعوى المدنية ونشأتها، حيث بينت الدراسة مفهوم الإدارة، ثم بينت مفهوم الدعوى، ثم عرضت الدراسة للمفهوم الكلي لمصطلح "إدارة الدعوى المدنية"، كما عرضت الدراسة لنشأة إدارة الدعوى المدنية في الأردن، ثم نشأتها في مصر ثم في فرنسا. ومن الأمور المهمة التي تناولتها هذه الدراسة، هي مهام قاضي إدارة الدعوى المدنية، أو قاضي التحضير، من حيث مراقبة الإعلانات وصحة الخصومة وعرض حل النزاع وعقد اجتماع مع الخصوم أو وكلائهم، والإشراف على تجهيز الدعوى لإحالتها إلى قاضي الموضوع. ثم بينت الدراسة صلاحيات قاضي إدارة الدعوى المدنية من حيث تثبيت الصلح أو الاتفاق، وفرض الغرامات. ثم عرضت الدراسة للطرق البديلة لتسوية النزاع في إدارة الدعوى المدنية، فتحدثت الدراسة عن العرض المباشر لتسوية النزاع بين الأطراف، ثم عرضت لحالة إحالة النزاع إلى الوسيط في حالة فشل تسوية النزاع. ثم اختتمت الدراسة بخاتمة تشتمل على بعض النتائج، ثم بعض التوصيات ذات الأهمية والمتعلقة بموضوع الدراسة.
|b The study of the subject of "civil lawsuit management" is summarized in identifying the nature of the management of this civil lawsuit and its origin, where the study showed the concept of management, then showed the concept of the lawsuit, then the study presented the overall concept of the term "civil lawsuit management", and the study also presented the emergence of the civil lawsuit administration in Jordan, then its inception in Egypt and then in France. Among the important matters dealt with in this study are: the tasks of the judge of the civil case management, or the preparatory judge, in terms of monitoring the announcements and the validity of the litigation, offering to resolve the dispute, holding a meeting with the litigants or their agents, and supervising the processing of the case to be referred to the trial judge. The study then showed the powers of the judge managing the civil case in terms of fixing the composition or agreement, and imposing fines. The study then presented the alternative party to settle the dispute in the civil lawsuit department, so the study talked about the direct offer to settle the dispute between the parties, and then presented the case of referring the dispute to the mediator in the event of failure to settle the dispute. Then the study concluded with a conclusion that includes some findings, and then some recommendations of importance and related to the subject of study.
