|a تعد ملكية الطوابق والشقق احك أفكار الملك الشائع الإجباري التبعي، وتخول الشريك حق الملكية فيصورها بالاستعمال بما يتفق مع طبيعته أو الغرض منه وبشرط أن لا يضر حقوق المالكين الأخرين، وعلى أن يراعي الشروط المدرجة في استعمال أي جزء مشترك في هذه الملكية وكذلك حق الاستغلال والتصرف، وأن كان التصرف والاستغلال يتم عن طريق الاستغلال والتصرف في الجزء المفرز، كما يكون للشريك حق في الطوابق والشقق تكون عليه التزامات، منها التزام الشريك في إعادة البناء في حالة تهدمه سواء كان في حال تهدم السفل أو تهدم البناء في ملكية الطوابق والشق، وكذلك التزامه في دفع الأعباء والتكاليف الناتجة عن الشيوع الإجباري التبعي.
