|a تدور فكرة هذا البحث حول العلامة التجارية وحق المالك في عدم الاعتداء على علامته التجارية الخاصة استنادا لقواعد المسئولية المدنية. فهدفت هذه الدراسة إلى بيان مدى أهمية العلامة التجارية في حفظ حقوق المالك لهذه العلامة، ومدى أحقيته في ظل التعويض لكل من تعدى على علامته التجارية الخاصة، استنادا لقواعد المسؤولية المدنية التي تحتم على كل من أرتكب خطأ وهذا الخطأ سبب ضرر للغير فهو ملزم بدفع تعويض. حيث توصلت الدراسة بأن نظام حماية العلامة التجارية السعودي قد عمل على تأمين الحماية الكافية من التعرض للعلامة التجارية وذلك من أجل حماية التاجر والمستهلك من أي تضليل قد يلحق بهم، أو في حالة ارتكاب أي مخالفة بناء عليها يتم الحصول على تعويض وذلك من خلال رفع دعوى المنافسة غير المشروعة.

This study aimed to demonstrate that a trademark is a means of preserving the rights of the trademark owner, and he also has the right to request compensation for any infringement of his trademark in any way, based on the rules of civil liability, which stipulate that every error that causes harm to a third party is obligated to pay the person who caused this harm. compensation. The study concluded that the Saudi trademark protection system worked to protect the merchant and consumer from any misleading that might befall one of them or the commission.
