|a يقصد بالتقاضي الإلكتروني تحاكم الأطراف إلى القاضي وفق قواعد المرافعات والجميع متفرقون في المكان. ويتسم التقاضي الإلكتروني بالسرعة وعدم استعمال المخاطبات والمذكرات الورقية. ويتم عن طريق تبادل المذكرات إلكترونيا أو الجلسات المرئية التي يشاهد القاضي الخصوم ويشاهدونه ويشاهد كل منهم الآخر دون أن يكون هناك لقاء بأبدانهم، وذلك عبر استخدام وسائل التقنية الحديثة مما يقلل فترة التقاضي وييسر على الخصوم. وتتم إجراءاته وفق الدليل الإجرائي للتقاضي الإلكتروني، ونظام المرافعات فيما لم يرد فيه نص، وقد نص الدليل الإجرائي على إجراءات تقديم الدعوى وحضور الجلسات، وصدور الأحكام. والتقاضي الإلكتروني له تأثير على مبدأ علانية التقاضي، كما أن قد يكون له تأثير غير ظاهر على مبدأ المساواة بين الخصوم.

This is done through the use of modern technology, which reduces the litigation period and makes it easier for the opponents. It is carried out in accordance with the procedures of the procedural guide for electronic litigation, and the pleadings system in what is not mentioned at the text. The procedural guide stipulates the procedures for filing a case, attending sessions, and issuing judgments. And electronic litigation has an impact on the principle of declared of litigation, and it may have inconspicuous effect on the principle of equality between opponents.
