|a يُعد التحليل والتعليق مهارةً وأداةً مقياس لجودة الأحكام القضائية، وقد عرض الباحث عدة تعريفات لمفهوم تحليل الحكم القضائي انتهى فيها إلى تعريفه بأنه: "ممارسة مؤهل أو متخصص لعملية تجمع بين الجانب النظري والتطبيقي؛ لتحليل عناصر الحكم القضائي المؤثرة، من خلال المهارات والأدوات المتخصصة، ومنهجية محددة ومعينة يختارها؛ لتحقيق مصلحة وغاية معتبرة"، كما تضمن البحث أهمية تحليل الأحكام القضائية، وبيان المجالات التي تكمن فيها عملية التحليل من حيث طبيعة الحكم القضائي، ومصدره، ونوعيته، وأجزائه واستعمالاته، كما تضمن البحث ضوابط تحليل الحكم والتي تعود إلى ثلاثة عناصر رئيسية وهي: المحلل الذي يقوم بعملية التحليل، والحكم أو الأحكام القضائية المستهدفة لذلك، وعملية تحليل الحكم بذاتها، كما تضمن البحث خاتمة تضمنت النتائج والتوصيات.

To achieve a significant interest and purpose." The Research also included the importance of analyzing judicial Judgments, and explaining the areas in which the analysis process lies in terms of the nature of the judicial Judgment, its source, quality, parts, and uses. The research also included the controls for analyzing the ruling, which go back to three main elements: the analyst who carries out the analysis process, and the targeted judicial ruling or rulings. Therefore, the process of analyzing the Judgment itself, and the research also included a conclusion that included results and recommendations.
