This study dealt with the nature of compensation for moral damage, by explaining the concept of moral damage, its types and conditions, and the extent to which it is permissible to compensate for moral damage, especially in light of the provisions of Law No. (22) of 2004 (Civil Law) and comparing the provisions of the last law in matters related to guaranteeing moral damage with the provisions of Islamic jurisprudence, where the study came to show the extent of guaranteeing compensation for moral damage in both civil law and Islamic jurisprudence, and then prove the legality of this compensation after studying the evidence of both those who support compensation for moral damage and those who oppose it. The study concluded that the Qatari legislator called for amending some provisions of the civil law related to compensation for moral damage, by adding an explicit text on the permissibility of compensation for moral damage in both tortious and contractual liability, and that the courts, when evaluating compensation for moral damage, should take into account the moral aspect of the injured person, as Small compensation may increase the pain of the victim, and finally call on the faculties of Sharia and Law at Qatar University to hold seminars that bring together scholars of Islamic law and scholars of legal science to exchange views on the concept of moral damage and its legitimacy. |
