|a تبين لنا أن المشرع الليبي كان سباقاً في معالجته لمشاكل الإرث بالطريق الجنائي، وهو السبيل الذي اهتدى إليه مؤخراً المشرع المصري في 2017، كما كان متطوراً بالنسبة لعصره في اللجوء للتهديد بالعقاب الجنائي، الأسلوب الذي أثبت فاعليته في معالجة العديد من النزاعات بين الأفراد خاصة حينما يكون محلها التزاماً بأداء شيء ما لأحد أطراف الخصومة، لكن رغم صياغة نصوصه الواضحة إلا أنه في الحالات القليلة التي عرض فيها الأمر للقضاء، ظهرت بعض الإشكاليات في التطبيق القضائي التي تثير التساؤل وفي هذا البحث نحاول الإجابة عن تلك التساؤلات وبيان ما في سلوك الطريق الجنائي من مصلحة وميزات للمجني عليه في جريمة الحرمان من الإرث من خلال دراسة إشكاليات التجريم، وإشكاليات رفع جنحة حرمان المرأة من الميراث للقضاء والعقاب عليها.
|b The Libyan legislator was proactive in addressing the problems of inheritance by criminal means, which is the way that the Egyptian legislator recently guided in 2017, and was also advanced for his time in resorting to the threat of criminal punishment, a method that proved effective in dealing with many disputes between individuals, especially when it is replaced by an obligation to perform something for one of the parties to the litigation. But despite the formulation of its clear texts, but in the few cases in which the matter was presented to the judiciary, some problems appeared in the judicial application that raise questions and in this research we try to answer those questions and indicate what in the conduct of the criminal road of interest and advantages of the victim in the crime of deprivation of inheritance by studying the problems of criminalization, and the problems of raising the misdemeanor of depriving women of inheritance to eliminate and punish them.
