|a تهدف الدراسة عبر- اتباع المنهج الاستقرائي التحليلي- إلى بيان المقصود بالماء الجاري، وبيان حد الجريان للماء، وحكم الوضوء من شط النهر الجاري، وحكم غسل الثوب النجس في الماء الجاري، وتظهر مشكلة البحث في بيان حكم استعمال الماء الجاري في الوضوء والغسل؛ لما يمكن أن يتضمنه من كونه مصدرا للحياة، وحكمه إذا تلوث، ليخلص القارئ إلى أن أمر تلوث الماء الذي اعتنت به النصوص، منعا للضرر، وأن الماء حق من حقوق الارتفاق، وأن مقصد حفظ النفس يتحقق بالمحافظة على نظافة الماء الجاري، وأنه يجوز الوضوء من شط النهر الجاري، وأوصي بإجراء بحوث علمية تعطي نتائج ملموسة عن اتباع التعاليم الشرعية في استعمال المياه، وتبين أثر ذلك في ترشيد استهلاك المياه.
|b The study, through the inductive analytical method, aims to clarify what is meant by running water, the limit of water flow, the rule of ablution from the riverbank, and the rule of washing an impurity/unclean garment by running water. The research problem appears in clarifying the rule of using running water for Al Wodoo’ and Ghasl as it can be a source of life and its rule if it is contaminated. The reader concludes that water pollution case discussed by many texts is for preventing harm, water is one of easements right, self-saving is achieved by keeping the running water cleanness, and the possibility of ablution from the running river. Thus, it is recommended to conduct scientific research that gives clear results on following the Islamic teachings in water use and shows the impact of this in rationalizing water consumption.
