|a تتمحور فكرة هذا البحث حول تسليط الأضواء على تأصيل الأحكام المتعلقة بمحيطات الأعمال، وسبل التوفيق بين النصوص الشرعية المتعلقة بها، حيث ذكرت أبرز الأسباب المؤثرة في اختلاف أهل العلم في هذه النصوص الشرعية، وحصرتها في سببين جوهريين. يتمثل السبب الأول في أثر الخلاف العقائدي في اختلاف أنظار أهل العلم في هذه النصوص الشرعية. ويتمثل السبب الثاني في أثر القواعد الأصولية في تأصيل الأحكام الشرعية المتعلقة بالمحيطات، وذلك عن طريق توظيف هذه القواعد الأصولية في توجيه النصوص الشرعية الواردة في محبطات الأعمال. وخلص البحث إلى بيان مدى أهمية الدراسة الأصولية، وأثرها في الفهم السليم للنصوص الشرعية المتعلقة بمحيطات الأعمال، ودفع الإشكالات المتوهمة عنها. وذلك مما يسهم في تفنيد شبهات أهل الأهواء، وإبطال أصولهم العقائدية التي حرفوا بها النصوص الشرعية المتعلقة بالمحبطات عن المعنى الصحيح لها.
|b This research deals with shedding lights on the rooting of the jurisprudence of rulings related to business frustrations, and ways of reconciling the legal texts related to them. The first reason is the impact of doctrinal disagreement in the different views of scholars on these legal texts, and three well-known schools of thought were mentioned. The second reason for the impact of the fundamentalist dispute is in the rooting of the Sharia rulings related to the frustrations, and that is by applying the fundamentalist rules in dealing with the legal texts contained in the business frustrations. The research concluded the extent of the importance of the study of fundamentalism in the correct understanding of the legal texts related to the frustrations of deeds, and repelling the delusional doubts about them, which contributes to refuting the suspicions of the people of desires, and invalidating their ideological principles that they built in the light of these legal texts.
