|a ذمة المرأة المالية، وما يلحق بها من حقوق وتصرفات، من القضايا المهمة التي تثار حولها الشبهات من حين لآخر؛ نظرا لتباين القوانين واختلاف الأعراف، ولا سيما في ظل الدعوات المغرضة، التي تدعي تحرير المرأة وإنصافها، ومحاولاتهم المستمرة باتهام الإسلام وعلمائه بظلم المرأة، وسلب حريتها، وجعلها تابعة للرجل، وهضم كثير من حقوقها. ومن هنا كانت أهمية البحث، وهو أن تفقه المرأة حدود ذمتها المالية، ومدى حريتها في التصرف في مالها، قبل الزواج وبعده؛ منعا للخلافات، ودرءا للتظالم؛ ولا سيما بين الزوجين؛ لحساسية العلاقة بينهما، ولتوضيح مدى تكريم الإسلام للمرأة، وحفظه لحقوقها كاملة، ولبيان حكمة المشرع الحكيم من إقالة ذمة المرأة المالية، وإقرار أهليتها للتملك والتصرف في مالها. وقد ركز هذا البحث على تناول مفهوم الذمة في اللغة والاصطلاح الشرعي وخصائصها، والعلاقة بينها وبين الأهلية، مع بيان أهلية المرأة للتملك وحرية التصرف في مالها، والحكمة من استقلال الذمة المالية للمرأة. وقد جاء البحث مدعوما بالأدلة الشرعية، وبآراء الفقهاء الموثقة من مصادرها الأصلية، مع الموازنة بينها، وربطها بالواقع المعاصر ما أمكن، وإظهار الرأي الأقرب إلى روح ديننا الحنيف ورحمته.
|b The financial liability of women, and the rights and actions associated with it, is one of the important issues that is periodically questioned due to the varying laws and differing customs. This is especially true in the face of malicious calls claiming to liberate and do justice to women, with their continuous attempts to accuse Islam and its scholars of oppressing women, stripping them of their freedom, making them subordinate to men, and infringing on their rights in many cases. Therefore, the importance of this study lies in helping women understand the limits of their financial liability and their freedom to manage their assets, both before and after marriage. This understanding is crucial to prevent disputes and injustices, especially between spouses, due to the sensitive nature of their relationship. The study also aims to highlight how Islam honors women and fully preserves their rights. It clarifies the wisdom behind the legislator’s decision to grant women financial autonomy and acknowledge their eligibility to own and manage their assets. This study focuses on the concept of financial liability in both linguistic and Islamic legal terms, its characteristics, and its relationship with eligibility. It examines a woman’s eligibility to own property and her freedom to dispose of it, as well as the rationale behind the financial independence granted to women. The research is supported by Sharia evidence and the documented opinions of jurists from their original sources, with a balance between them. It also relates these views to contemporary reality as much as possible, presenting the opinion closest to the spirit and mercy of Islam religion.
