|a يهدف البحث إلى التعريف بالحديث الصحيح وشروط صحته، ثم تناول عدة ضوابط للعمل بالحديث الصحيح، وصولا إلى أصل البحث وأساسه، وهو أسباب ترك العمل بالحديث الصحيح، فتناولها البحث في القسم الدراسي تناولا مجملا، ثم كان الحديث عنها بالتفصيل في القسم التطبيقي، فذكر البحث جملة من الأسباب والعلل المؤدية لترك العمل بالحديث الصحيح، التي كان منها: النسخ ومعارضة الحديث الصحيح بما هو أصح منه، وتأويل ظاهر معناه، ومخالفة ظاهر الحديث لأصول الشريعة، إلى غير ذلك من العلل التي تناولها البحث، والتي عمل على شرحها شرحا وافيا من خلال عرض الأمثلة التطبيقية الموضحة لتلك الأسباب، وتوصل إلى، أن ثمة ضوابط لترك العمل بالحديث الصحيح، وليس الأمر متروكا للتشهي أو لما وافق العقل أو خالفه. وأن بعض الأمثلة الوارد ذكرها في البحث، محل عمل لبعض الفقهاء، وإن كان عامة الفقهاء قد تركوا العمل بها. وتبين أن بعض الأحاديث الصحيحة الإسناد، ترك أهل العلم العمل بها لسبب من الأسباب المعتبرة عندهم علما وتفقها، وليس من عند أنفسهم.
|b The study aims to define authentic hadith and the conditions for its authenticity, elaborating several regulations for applying the authentic hadith and the reasons for abandoning authentic hadith. This topic is addressed in the theoretical section, followed by a detailed discussion in the practical section. The study identifies various reasons and causes for abandoning the application of authentic hadith, including: abrogation, contradiction of the authentic hadith by a more authentic one, interpreting its apparent meaning, and the apparent contradiction of the hadith with the principles of Sharia, among other reasons. These causes were explained comprehensively through practical examples that illustrate these reasons. The study concluded that there were specific regulations for abandoning the application of authentic hadith, and that it was not left to personal inclination or rational agreement or disagreement. Some examples mentioned in the research were actually applied by some jurists, even though the majority had abandoned them. It was clear that some hadiths, while having a sound chain of transmission, were abandoned by scholars due to valid reasons based on their knowledge and understanding, not arbitrarily
