|a تقوم فكرة المساواة على عدم التمييز بين الناس على أساس اللون أو العرق أو الدين أو اللغة أو غيرها من معايير التمييز بين الناس، ويرتبط هذا المبدأ بباقي الحقوق والحريات، إذ لا تستقيم ممارسة حقوق الإنسان دون توفير مبدأ المساواة بين الناس في التمتع بها، هذا ما دفع البعض إلى اعتبارها أصل جميع الحقوق ومصدرها، تكمن إشكالية مبدأ المساواة في تحديد المفهوم وحصر أبعاده ومنطلقاته الفكرية والفلسفية، فضلا عن ضماناته القانونية والقضائية وتأثيراته المجتمعية. شكل مبدأ المساواة غاية المجتمعات الحديثة بعد عصور من العبودية والتمييز بين الناس، لذلك تلتزم جل الدول بالاتفاقيات الدولية المناهضة للتمييز وتعمل على بلورة مضامينها ضمن القوانين الوطنية.
|b The idea of equality is based on non-discriminating between individuals regardless their color, race, religion, language or any other criteria. This principle is associated with all other rights and freedoms. The practice of human rights cannot be fully realized without providing the principle of equality among people. This led some to consider it as the origin of the source of all rights. The problem with the principle of equality lies in defining its concept and its intellectual and philosophical dimensions, as well as ensuring its legal and judicial guarantees and its societal impacts. The principle of equality is the aim of modern societies after the slavery ages and discrimination among individuals, so most countries adhere to international conventions against discrimination and work towards clarifying its contents within their national laws.
