لقد جاءت هذه الدراسة ببيان أحد أهم وأعمق علوم أصول الفقه الإسلامي، ذلك العلم الذي يعد أساس معرفة أدلة التشريع الإسلامي، واستنباط الأحكام منها، فعلم مقاصد الشريعة هو أحد أهم محاور هذا العلم العظيم، فهو الباحث عن مرادات الشارع ومقاصده. إن هذه الدراسة لتصل بالقارئ والباحث في العلوم الشرعية إلى حقيقة عظيمة تجلي فيها الغموض وتفتح فيها الأذهان إلى ما تريده الشريعة والشارع الحكيم من العباد، بإدراك القصود والمرادات، وليس الوقوف عند ظاهر النصوص وإنما أن يستخرج المعاني المقصودة والغايات المرادة من أعماق النصوص أو حتى قياسا على تلك النصوص من دون تعارض مع أصول الشريعة ولا مع أدلتها الكلية. وتوضح هذه الدراسة ارتباط علم المقاصد الشرعية وعلاقته بالحكم والغايات والمآلات والقواعد الفقهية الكبرى ونظرية المصلحة في الشريعة الإسلامية والتي تعد من أهم المحاور التي تقوم عليها فكرة التشريع الإسلامي، وذلك من خلال توظيفات عملية وأمثلة تطبيقية من القرآن والسنة وباقي الأدلة.
This study came with a statement of one of the most important and deepest sciences of the principles of Islamic jurisprudence, that science, which is the basis of knowledge of evidence of Islamic legislation, and the deduction of rulings from them. The science of the purposes of Sharia is one of the most important axes of this great science, it is the researcher for the will of the street and its purposes. This study aims to bring the reader and researcher in the legal sciences to a great truth in which ambiguity is manifested and minds are opened to what the Sharia and the wise legislator want from the people, by realizing the purposes and intentions, and not standing at the apparent texts, but to extract the intended meanings and desired goals from the depths of the texts or even by analogy with those texts without conflict with the principles of Sharia nor with its overall evidence. This study illustrates the link between the science of legal purposes and its relationship to governance, goals, outcomes, major jurisprudential rules and the theory of interest in Islamic law, which is one of the most important axes on which the idea of Islamic legislation is based, through practical employment and applied examples from the Qur'an, Sunnah and other evidence.
