|a إن المقاصد الشرعية من أهم ما تبنى عليها أحكام النوازل الفقهية عند النظر فيها، ومقصد مراعاة المصلحة في الشريعة الإسلامية قاعدة عظيمة وباب واسع تجول فيه أنظار المجتهدين، وتبرز أهمية الاجتهاد في النوازل إذا كانت متعلقة بالحج الذي هو أحد أركان الإسلام الخمسة المفروضة حيث يؤديه ملايين البشر كل عام، ومن هذا الباب كان لا بد من النظر المصلحي في نوازل الحج، وقد أعمل في هذا البحث منهج الدراسة الموضوعية وذلك بالتأسيس المقاصدي لكل قاعدة من قواعد النظر المصلحي، من خلال تحرير وتقرير القاعدة المصلحية مفهوما وحجية ودليلا؛ وأعمل المنهج التحليلي في توظيف القاعدة المصلحية في نوازل الحج؛ من خلال كشف حال النازلة أولا، ثم الفتوى المقررة بإزائها من الهيئات العلمية والمجامع الفقهية، ثم التكييف المقاصدي المصلحي لأحكام نوازل منسك الحج، ومن أهم نتائج البحث: وجود نوازل عدة من نوازل الحج تأثرت بالنظر المصلحي وأنبني الاجتهاد فيها على قواعد هذا النظر، كما أن إعمال النظر المصلحي لا بد له من ضوابط تحققه، ومن توصيات البحث المساهمة في تفعيل الدراسات المقاصدية وتوظيفها في النوازل الفقهية، ومشاركة أهل القرار وصناعه في تقديم حلول شرعية معتبرة لما يعرض للناس من مسائل ومستجدات في شتى مجالات الحياة.
|b The purposes are among the most important things on which the rulings of jurisprudence on new issues are built, and the principle of observing interests of people in Islamic law is a great rule and a wide field for scholars who aim to reach juristic rulings through reasoning. The importance of rulings on new matters through reasoning emerges if they are related to Hajj, since it is one of the five pillars of Islam and millions of Muslims perform it every year. Therefore, it is necessary to consider the new issues related to Hajj. In this study, I have employed the objective study approach, which is based on the objectives of each rule of the beneficial view through the establishment and determination of the beneficial rule in terms of concept, validity and evidence. I also employed the analytical approach in employing the beneficial rule in issues of Hajj by clarifying the case of the new issue, the fatwa/s issued on it by the concerned bodies and the jurisprudential councils, and the purposeful adaptation of the rulings on Hajj issues. The most important results of the study is that many new Hajj issues have been affected by the beneficial view, and that the beneficial view should be subject to precepts that control it.
