المستخلص: كان موضوع الرسالة "دراسة وتحقيق من مخطوط مواهب الجليل في تحرير ما حواه مختصر خليل للعلامة على زين العابدين محمد بن أبي محمد زين الدين عبد الرحمن بن على أبي الإرشاد نور الدين الأجهوري المالكي ت: (١٠٦٦هـ) من أول فصل قوله (إذا اختلف المتبايعان) إلى قوله (وفي الرقيق والقدر والبكارة واللون)" وقد اشتمل البحث على مقدمة وثلاثة أقسام وخاتمة، وفهارس. أما المقدمة فقد تضمنت: أهمية البحث، أسباب الاختيار، الدراسات السابقة، المنهج وأدوات العمل. أما القسم الأول فاشتمل على التعريف الشيخ خليل صاحب المختصر ثم الحديث عن المختصر، ثم الحديث عن صاحب الشرح الشيح على الأجهوري، ثم الحديث عن الشرح (المخطوط) وأما القسم الثاني وهو خاص بالنص المحقق وحواشيه، ويشتمل على فصلين (حكم اختلاف المتبايعين، أحكام السلم)، وأما القسم الثالث: فهو مشتمل على ثلاث مسائل مقارنة: الأولى: حكم السلم في الحيوان، الثانية: اشتراط الأجل في القرض، الثالثة: تضمين الصناع، وأما الخاتمة: ضمنتها أهم النتائج التي توصلت إليها من خلال البحث مثل ما لا يجوز السلم فيه لا يجوز قرضه فيمتنع قرض جلد ميتة دبغ بمثله، والمعاملات الإسلامية وخاصة المتعلقة بالبيوع من أهم الأبواب الفقهية والتي تحتاج لمزيد من الأبحاث والدراسات لإيجاد بدائل إسلامية للمعاملات المعاصرة الغربية والتي يحتوي البعض منها على أمور ممنوعة في الشريعة الإسلامية، ومن ذلك تفعيل السلم في البنوك مع الضوابط الشرعية، ثم ذيلت البحث بفهارس فنية لخدمة البحث، والله ولي التوفيق.

The subject of the thesis is "A study and Investigation of the Manuscript of Mawahib Al-Jalil in Editing what it Contained in Mukhtasar Khalil by the Prominent Religious Scholar Ali Zayn al-Abidin Muhammad Ibn Abi Muhammad Zayn Al-Din Abd Al-Rahman Ibn Ali Abi Al-Irshad Nour Al-Din Al-Ajhuri al-Maliki, (died in 1066 AH) from the first chapter of his saying (if the two parties differed) to his saying (and in the slave, the destiny, the virginity, and the color)." The research included an introduction, three sections, a conclusion, and indexes. The introduction included: the importance of research, reasons for selection of the study topic, previous studies, its methodology and work tools. As for the first section, it included the definition by Sheikh Khalil, the author of Al-Mukhtasar, then the hadith about Al-Mukhtasar, then the hadith from the author of the explanation, Sheikh Ali Al-Ajhouri, then the talk about the (manuscript) explanation. As for the second section, it is specific to the verified text and its footnotes, and includes two chapters [the ruling on disagreement between the two parties to the contract, and the rulings on peace]. As for the third section; it includes three comparative issues, firstly: the ruling on peace in animals, secondly: the stipulation of a term in a loan, and thirdly: the inclusion of artisans. Concerning the conclusion, it included the most important findings reached through this research, such as what is not permissible in which peace is permitted. It is not permissible to loan it, as it is not permissible to loan the skin of a tanned dead animal for the same. Islamic transactions, especially those related to sales, are among the most important sections of jurisprudence, which need more research and studies to find Islamic alternatives to contemporary Western transactions. In addition, some of which contain matters prohibited in Islamic law, including activating peace in banks with controls. Legality, then I concluded and ended the research with technical indexes to serve the research, and Allah (the Almighty) is the Grantor of success.
