The first article of the United Nations Charter lists among the purposes of the Organisation the maintenance of peace (paragraph 1) , the development of friendly relations among nations based on respect for the principle of equality and self-determination of peoples (paragraph 2) , and finally the promotion of respect for human rights and fundamental freedoms (paragraph 3). The very order of this enumeration may reveal the intention of the drafters of the Charter to give priority to the maintenance of peace among the stated purposes. It was above all to "save succeeding generations from the scourge of war" (first paragraph of the Preamble) that the founding fathers of the Organisation met in San Francisco in 1945. Consequently, the functional relationship between human rights and peace in conflict prevention has been operationally proven. In operational terms, this translates into a twofold action: action through the verification and promotion of human rights on the ground, and structural action through the strengthening and entrenchment of the rule of law.
L’article 1 de la Charte des Nations Unies mentionne parmi les buts de l’Organisation le maintien de la paix (paragraphe 1) , le développement des relations amicales entre nations basées sur le respect du principe de l’égalité et de l’autodétermination des peuples (paragraphe 2) , et finalement la promotion du respect des droits de l’homme et des libertés fondamentales (paragraphe 3). L’ordre même de cette énumération pourrait révéler l’intention des rédacteurs de la Charte de réserver, parmi les finalités indiquées, une place prioritaire au maintien de la paix. C’était avant tout pour «préserver les générations futures du fléau de la guerre» (premier alinéa du Préambule) que les pères fondateurs de l’Organisation s’étaient réunis à S. Francisco en 1945. Partant, les rapports fonctionnels entre les droits de l’Homme et la paix dans la prévention conflictuelle sont opérationnellement prouvés. Ceci se traduit opérationnellement par une double action: une action par la vérification et la promotion des droits de l’Homme sur le terrain, et une action structurelle par le raffermissement et l’enracinement de l’Etat de droit.
