|a على الرغم من أن القانون الوطني وجد من اجل توفير الحماية لجميع أفراد المجتمع ضد الجريمة، لكن توجد بعض فئات المجتمع تحتاج إلى حماية بشكل أكبر وذلك نظرا للوضع الذي يكونون به من هذه الفئات هم مجهولين النسب، ولأجل توفير الحماية الجنائية المناسبة لوضعهم يجب في البداية تحديد من هم أصحاب هذه الفئة ومن ثم البحث في مدى كفاية الحماية الجنائية التي وفرتها القوانين العقابية لهذه الفئة من المجتمع من خطر جرائم الماسة بحياتهم وسلامتهم الجسدية والعقلية.
