المستخلص: The adoption of new technologies has significantly impacted the legal field, fundamentally altering how legal processes are conducted and how laws are enforced. Indeed, the field of law has undergone a substantial change with the evolution of electronic transactions and, consequently, with the frequent use of electronic signatures. As a critical pillar of digital transformation in both public and private sectors, the electronic signature plays a crucial role in enhancing the speed, efficiency, and security of services, especially in electronic transactions. This article aims to position the electronic signature within the specific strategic context of Morocco and to highlight the legal framework that governs the use of this technological process. It also seeks to identify and analyze the various shortcomings associated with the use of this technological tool and to present a range of solutions and recommendations to address related dysfunctions.

L'adoption des nouvelles technologies a impacté significativement le domaine juridique, modifiant fondamentalement la manière dont les processus légaux sont conduits et la façon dont les lois sont appliquées. En effet, le droit a connu un changement de taille avec l’évolution des transactions électroniques et par ricochet avec l’usage fréquent de la signature électronique. Pilier essentiel de la transformation numérique à la fois des secteurs public et privé, la signature électronique joue un rôle crucial dans l’optimisation de la rapidité, l’efficacité et la sécurité des services et spécialement des transactions électroniques. Cet article a pour but de positionner la signature électronique dans le contexte stratégique spécifique au Maroc et de mettre en lumière le cadre légal qui encadre l’utilisation de ce procédé technologique. Il a également pour objectif d’extraire et d’analyser les différentes insuffisances liées à l’usage de cet outil technologique et de présenter une panoplie de solutions et de recommandations afin de pallier aux dysfonctionnements y afférent.
