|a يطرح موضوع مسؤولية وكيل الأسفار تجاه المستهلك إشكالية الأساس القانوني للتعويض عن الأضرار التي يمكن أن تلحق بهذا الأخير، والتي يمكن تقسيمها إلى قسمين؛ أضرار ناتجة عن تنفيذ خدمة من طرف وكيل الأسفار، وأضرار عن عدم تنفيذ الناقل أو الفندقي لما هو ملزم به، ففي الحالة الأولى يثير المستهلك خطأ شخصي بالنسبة للوكالة، وفي الحالة الثانية يثير مسؤوليتها عن التزام الغير.
