المستخلص: لقد اهتم علماء المسلمين قديما وحديثا ببيان مسائله، وتوضيح مطالبه، وهناك مسائل في التناقض في الإقرار في الحدود، نريد معرفة الأثر المترتب على التناقض فيها، فأحببت أن يكون بحثي بعنوان: (الآثار القضائية للتناقض في الإقرار في الحدود دراسة تأصيلية)، والهدف من البحث: دراسة مسائل التناقض في الإقرار في الحدود، وذكر الأثر المترتب على تلك المسائل، ودراستها دراسة فقهية مقارنة، لتسهيل الوصول إليها، والاستفادة منها، وقد اعتمد الباحث على المنهج الوصفي التحليلي، وجاء تقسيم البحث إلى مقدمة، وفيها الافتتاحية، والأهمية العلمية للموضوع، وأسباب اختياره، والدراسات السابقة، وخطة البحث، ومنهجه، وتمهيد: في بيان مفردات عنوان البحث، ومبحث في الآثار القضائية للتناقض في الإقرار في الحدود، وكانت أهم نتائج البحث: أن الأثر المترتب على المقر المتناقض في الحدود الخالصة لله عز وجل إذا رجع فإنه يصح منه، وأن الأثر المترتب على المقر المتناقض في الحقوق المشتركة كحد القذف من الأخرس، فإنه يؤخذ بإقراره، ويحد للقذف، وكحد السرقة فإن تناقضه يؤثر في درء الحد عنه، دون الضمان.

Muslim scholars, both ancient and modern, have been interested in clarifying its issues and explaining its topics. There are issues of contradiction in confession on punishments, and we want to know the effect resulting from the contradiction in them. I titled my research as: (The Judicial Effects of the Contradiction in Confession in the Punishments: A Foundational Study). The aim of the research is to study the issues of contradiction in confession in the punishments, and to mention the effect resulting from those issues, and to study them in a comparative jurisprudential study, to facilitate access to them and benefit from them. The researcher relied on the descriptive analytical approach, and the research was divided into an introduction, which includes the opening, the scientific importance of the topic, the reasons for choosing it, previous studies, the research plan, and its approach, and a preface: in explaining the terms of the research title, and a section on the judicial effects of contradiction in confession on punishments. The most important results of the research were: that the effect resulting from the contradictory confessor on punishments purely for Allah Almighty, if he returns, then it is valid from him, and that the effect resulting from the contradictory confessor in the shared rights, such as the punishment of slander from a mute, then his confession is taken into account, and he is punished for slander, and the punishment of theft, his contradiction affects the prevention of punishment, without guarantee.
