|a لقد تضمن المرسوم الجديد للصفقات العمومية والذي دخل حيز التنفيذ في فاتح شتنبر 2023، عددا من الإصلاحات والمستجدات التي تهدف إلى تبسيط وتحسين قواعد إبرام وتدبير ومراقبة الصفقات العمومية من جهة، والرفع من جودة الممارسات المتعلقة بها من جهة أخرى. وفي هذا الصدد، فإن للقضاء الإداري مكانة بارزة في منازعات الصفقات العمومية، فبالإضافة إلى حرصه على تفعيل دور الصفقات العمومية كرافعة أساسية للتنمية الاقتصادية للطلبية العمومية، فإنه يسهر على تكريس التدبير المرتكز على النتائج وعلى نجاعة الأداء في كل ما يعرض عليه من نزاعات بهذا الخصوص.
|b The new public procurement decree, which entered into force on September 1, 2023, included a number of reforms and developments aimed at simplifying and improving the rules for concluding, managing and monitoring public procurement on the one hand, and raising the quality of related practices on the other hand. In this regard, the administrative judiciary has a prominent position in public procurement disputes. In addition to its keenness to activate the role of public procurement as a basic lever for the economic development of public demand, it ensures the establishment of results-based management and the efficiency of performance in all disputes presented to it in this regard.
