المستخلص: تحظى حقوق الطفل باهتمام خاص من قبل القانون الدولي لحقوق الإنسان، ومن قبل المنظومة الحمائية الدولية، لأن الطفل يصنف ضمن الفئات الهشة التي تتطلب تدابير خاصة، وهذه الأخيرة ينبغي ألا تفسر في الإطار الرسمي وفي المجال الضيق، بل عليها أن تأخذ الطابع الفعلي في إطار التفسير الواسع، وينبغي كذلك صياغة تفضيليات خاصة تراعي سن الطفل وإمكانياته البدنية والعقلية والنفسية. وهذه خطوات ضرورية لتفعيل النص القانوني وفق منطق سيادة القانون وفي إطار الدولة الحاضنة التي تراعي ظروف الطفل ومتطلباته، مع الحرص على تفعيل الأولوية القصوى لحقوق الطفل، وإيلاء الاعتبار الأول للمصلحة الفضلى للطفل. إن هذه المعايير لا يمكن تبرير الاستغناء عنها تحت أية وضعية كانت، سواء في حالات الحرب أو الكوارث الطبيعة أو الأمراض الجائحة أو التغيرات المناخية فهي معايير ثابتة لتأكيد حماية الطفل واحترام حقوقه، وفي نفس الوقت هي مرتكزات أساسية لتأكيد وجود مجتمع ديمقراطي يستوعب الحماية الفعلية لدى جميع مكوناته.

Children's rights receive special attention from international human rights law and the international protection system, because children are classified as vulnerable groups that require special measures, and the latter should not be interpreted within the official framework and in a narrow field, but rather they must take on an actual nature within the framework of interpretation. Broad, special preferences should also be formulated that take into account the child's age and his physical, mental and psychological capabilities. These are necessary steps to activate the legal text in accordance with the logic of the rule of law and within the framework of the custodial state that takes into account the child's circumstances and requirements, taking care to activate the highest priority for the rights of the child, and giving first consideration to the best interest of the child. These standards cannot be justified under any situation, whether in cases of war, natural disasters, pandemic diseases, or climate change. They are fixed standards to confirm the protection of children and respect for their rights, and at the same time, they are basic foundations for confirming the existence of a democratic society that accommodates effective protection for all its components.
