|a إن تحليل مبدأ التمييز الإيجابي بميثاق الاستثمار 03.22 في إطار مسعى تحقيق العدالة المجالية وتهذيبها، وطموح تشجيع الاستثمار تبعا لمصفوفة الحوافز التي حملها ميثاق الاستثمار والقوانين التنظيمية المصاحبة له، في هذه الورقة، يستلزم تقديم تعريف لماهية التمييز الإيجابي والجذور التاريخية له، والمزايا والفوائد المستخلصة من توظيفه في المقاربات العلاجية والتصحيحية التي خلفتها بعض ممارسات وتدابير السياسات العمومية في تدبير الشأن العام وكذا المخاوف والتوجهات الواردة عليه، ثم إبراز تجليات التوظيف التصحيحي والعلاجي للتمييز الإيجابي كتدبير يسعى للتقليص والحد من التفاوتات والتمايزات المجالية الترابية التي كرستها السياسات العمومية بمنظومة الاستثمار على مستوى الجهات المكونة لعموم التراب الوطني، ثم تسليط الضوء على تمظهرات توظيف المشرع آلية ومبدأ التمييز الإيجابي كآلية من الآليات التي يتم توظيفها نحو تحقيق طموح تحفيز الاستثمار والتشجيع عليه تبعا لمنطوق النصوص التشريعية والقانونية المؤطرة له.
|b In this paper, the analysis of the principle of positive discrimination in the Investment Charter 03.22 within the framework of an effort to achieve and refine territorial justice, and the ambition to encourage investment according to the matrix of incentives contained in the Investment Charter and its accompanying regulatory laws, It requires providing a definition of what positive discrimination is, its historical roots, and the advantages and benefits derived from its employment in the therapeutic and corrective approaches left by some public policy practices and measures in managing public affairs, as well as the fears and apprehensions related to it, and then highlighting the manifestations of the corrective and remedial employment of positive discrimination as a measure that seeks to reduce and limit The regional and territorial disparities and distinctions established by public policies in the investment system at the level of the regions that make up the entire national territory, Then, shedding light on the manifestations of the legislator's employment of the mechanism and principle of positive discrimination as one of the mechanisms that are employed towards achieving the ambition of stimulating and encouraging investment according to the text of the legislative and legal texts framing it.
