إن مفهوم الإنسانية للرياضة على مر العصور لا يعرف حدودا فنجد بعض الحضارات تعتبر الرياضة عسكريه والبعض الآخر وسيله للترفيه كما تلعب الرياضية دورا هاما في حمياه الجسم من الأمراض المختلفة وتحافظ على الشباب من الاتجاه نحو الانحرافات السلوكية وأخيرا تربيه بدنيه وفي اطار مناسب من القيم وبالتالي كان لابد من وجود قانون يحافظ على تلك الممارسات الرياضية في الملاعب وبالتالي يجب أن نوضح الفرق بين أنواع الرياضة كالرياضيات العنيفة كالمصارعة والملاكمة والرياضية الجماعية ككره القدم التي تعتبر هي اكثر الرياضات انتشارا والتي بسببها تنتج العديد من الجرائم الرياضية كالعنف في الملاعب من قبل اللاعبين أو تناول المنشطات قبل المباراة أو تنتقل المسؤولية الجنائية للجمهور أثناء التشجيع من أحداث الشغب أثناء التشجيع وقد تؤدي العصبية الرياضية إلى بعض الكوارث ولا سيما أحداث ستاد بور سعيد من مقتل العشرات من المشجعين أثناء مشاهده بعض المباريات وقد تنتقل الجريمة أيضا إلى رشوه الحكم من بعض الأجهزة الفنية لتزوير النتائج أو عدم الحكم بالعدل بين الفريقين. فكان لابد من سن قانون ينظم ممارسه الرياضة داخل الملاعب وأجهزة للكشف على اللاعبين قبل المباريات حتى نستطيع الكشف عليهم من تناول المنشطات أو غيرها بالإضافة إلى الاتحادات الرياضية الدولية والوطنية التي تعمل على فض المنازعات والتأكيد على الالتزام بالقوانين وظهرت لنا إشكالية في عدم وجود تشريعات جنائية لتجريم تناول المنشطات والمعاقبة عليها. فكان لزام علينا إيضاح مفهوم الجريمة الرياضية في نظر التشريع وتطبيق الجريمة الرياضية في التشريع وماهي المسؤولية القانونية عن تناول المنشطات للاعبين ودور لجان التحكيم في منع تلك الأفعال الغير قانونيه ومدي إسهامها في منع العنف الرياضي الذي كان نتيجة حتميه لتناول المنشطات والتأكيد على المسؤولية الجنائية عن جريمة التلاعب بالنتائج والمراهنات الرياضية ولا سيما طبقا للاتفاقيات الدولية والتأكيد على الإجراءات القانونية حيال التلاعب بالنتائج في المباريات وسن قوانين صارمة للحد من العنف في الملاعب وتناول المنشطات وأحداث شغب من قبل الجماهير والتفتيش الإلكتروني قبل دخول الجمهور لتجنب احتكاك الجمهور مع أفراد الأمن وتقليل انتهاك حقوق الإنسان مع الاحتفاظ بالتفتيش الوقائي للملاعب وتوضيح التوصيات من الكشف المسبق على اللاعبين للتأكد من تناول المنشطات.
