أن الشريعة الإسلامية مبناها وأساسها على الحكم ومصالح العباد في المعاش والمعاد، وهي عدل كلها ورحمة، والمتأمل في عصورنا المتأخرة يعجب أشد العجب لهذا التطور السريع في شتى ميادين العلم والمعرفة، والتغير الكبير في حال المجتمعات كان له الأثر الكبير في وجود كثير من القضايا الفقهية المعاصرة التي لابد لها من بحث وتأصيل وتوصيف فقهي إلى حكمها وبيان الكثير من الأحكام ومنها ما يتعلق بالقياس والاستحسان وتطبيقاته الفقهية المعاصرة وفي هذا البحث نحاول جمع أقوال الفقهاء المتفرقة في كتبهم حول الأحكام الفقهية الدائرة بين القياس والاستحسان وتطبيقاتها الفقهية المعاصرة في الفقه الإسلامي من بداية كتاب الذبائح والصيود إلى نهاية كتاب الكفارات دراسة فقهية مقارنة بين المذهب الحنفي والمذاهب الفقهية الأخرى، وقد تم تناول ذلك على النحو التالي: تعريفات لمفردات البحث المبحث الأول: الأحكام الفقهية المطلب الأول: الأحكام الوضعية المبحث الثاني: القياس المطلب الأول: تعريف القياس المطلب الثاني: أركان القياس المطلب الثالث: أقسام القياس المطلب الرابع: حجية القياس المبحث الثالث: الاستحسان المطلب الأول: مفهوم الاستحسان المطلب الثاني: أقسام الاستحسان المطلب الثالث: حجية الاستحسان المبحث الرابع: الفرق بين القياس الأصولي وقياس الأصول وفيه مطالب: المطلب الأول: تعريف قياس الأصول المطلب الثاني: أركان قياس الأصول المطلب الثالث: شروط قياس الأصول المطلب الرابع: المسائل المتعلقة بقياس الأصول المبحث الخامس وفيه مطلب: بعض النماذج التطبيقية للحكم المبني على قياس الأصول.
Islamic law is built and based on governance and the interests of the people in this life and the next, and it is all justice and mercy.
