|a إن التعامل مع الأدلة التفصيلية في استنباط الأحكام الشرعية ووضع القواعد الأساسية الضابطة لهذا النوع من الاجتهاد قد فقد بفقدان الأئمة الذين كان لهم قصب السبق والاستقلال، مما كان ولا بد على من أتى بعدهم ممن هم في منزلتهم أو قاربوا تلك المنزلة أن يلحقوا ما لم ينص عليه أئمتهم بما نصوا عليه في الأصول والفروع، ذلك العلم المعبر عنه بعلم التخريج عند الأصوليين والفقهاء. ويعمد هذا البحث إلى: بيان نوع مهم من أنواع التخريج، وهو تخريج الأصول على الأصول، ذلك العلم الذي يختص باستنباط القواعد الاجتهادية من أصول أخرى منصوصة، سواء كانت تلك النصوص: لغوية، أو عقدية، أو أصولية، أو فقهية. وفي هذا البحث بيان لمفهوم تخريج الأصول على الأصول، مع ذكر بعض النماذج التطبيقية التي عمد الأصوليين إليها لتخريج القواعد الأصولية من قواعد أخرى أصولية وغيرها، وإبراز مدى عنايتهم واهتمامهم بهذا النوع من التخريج؛ فتوسعوا في هذا النوع من التخريج ولم يقصروه على قواعد الشرعية الكلية، أو المذهبية، متبعا في هذا البحث المنهج الاستقرائي، وتدعيمه بالمنهج التحليلي والاستنتاجي؛ لبيان مفهوم التخريج لدى العلماء، مزينا ذلك ببعض النماذج التطبيقية الموضحة لهذا الاهتمام والاعتناء.
|b Dealing with detailed evidences in deriving legal rulings and establishing the basic rules controlling this type of Ijtihad has been lost with the loss of the scholars who had the lead, which made it necessary for those who came after them, whether in their position or close to that position to attach what their Imams did not stipulate to what they stipulated in the principles and marginal issues, that is the discipline called Legal Derivation among the fundamentalists and jurists. This research aims to: clarify an important type of Legal Derivation, which is the Derivation of the principles from the principles, that discipline that specializes in deducing the rules of Ijtihad from other stipulated principles, whether those texts are: linguistic, doctrinal, fundamentalist, or jurisprudential. In this research, the concept of the Legal Derivation of principles from principles is clarified, with mention of some of the applied models that the scholars of the principles of jurisprudence have resorted to in order to derive the principles of jurisprudence from other principles of jurisprudence and others. Highlighting the extent of their care and interest in this type of derivation. They expanded this type of derivation and did not limit it to the rules of general or doctrinal legitimacy. I followed in this research the inductive approach, supporting it with the analytical and deductive approach, to clarify the concept of derivation among scholars, with some applied models that illustrate this interest and care.
