|a الجراحة التجميلية تؤدي إلى شعور الإنسان براحة ورضا أكبر حيال النفس، وفي كثير من الحالات يمكن استخدام الجراحة التجميلية لإصلاح بعض المشاكل الطبية. إلا أن جراح التجميل قد يرتكب خطأ طبيا أثناء إجرائه للجراحة التجميلية ينتج عنه تشوه للمريض، لعدم قيامه بما تفرضه عليه أصول ممارسة المهنة، أو نتيجة عدم اتخاذ الحيطة والحذر والتدابير اللازمة التي قررها المشرع أو المنصوص عليها في القانون أو البروتوكولات الطبية فيخضع للمسئولية الجنائية. وتهدف الدراسة إلى بيان الجوانب المختلفة للمسئولية الجنائية لجراح التجميل، وتوضيح خصوصيتها ونواحي تميزها عن القواعد العامة للمسئولية الجنائية، مع بيان وتوضيح أثر انعكاسات استخدام تقنيات الذكاء الاصطناعي على المسئولية الجنائية لجراح التجميل، وللإيفاء بمتطلبات موضوع البحث استخدم الباحث المنهج الوصفي، والتحليلي المقارن، وتوصي الدراسة بوضع تعريف لجراحات التجميل، يتم على أساسه تحديد طبيعة الأعمال الجراحية التجميلية التي تهدف إلى تحسين المظهر والتي تتسم بالضرورة الملحة، والأعمال الطارئة التي تهدف فقط إلى إزالة التشوهات الخطرة الناتجة عن الحوادث من أجل بيان الأسس التي تبنى عليها المسئولية الجنائية لجراح التجميل، مع توضيح لأسباب المسئولية الجنائية للذكاء الاصطناعي الجراحي الطبي من أجل توقيع عقوبات تتناسب مع طبيعته.
|b Plastic surgery leads to a person feeling more comfortable and satisfied with himself, and in many cases plastic surgery can be used to fix some medical problems. However, the plastic surgeon may commit a medical error during his plastic surgery that results in a deformity of the patient, for not doing what is imposed on him by the principles of practicing the profession, or as a result of not taking the necessary precautions and measures decided by the legislator or stipulated in the law or medical protocols, so he is subject to criminal liability. The study aims to clarify the different aspects of the criminal responsibility of the plastic surgeon, and clarify its specificity and aspects that distinguish it from the general rules of criminal responsibility, with a statement and clarification of the impact of the repercussions of the use of artificial intelligence techniques on the criminal responsibility of the plastic surgeon, and to meet the requirements of the subject of the research, the researcher used the descriptive and analytical approach، The study recommends the development of a definition of plastic surgery, on the basis of which the nature of plastic surgeries aimed at improving the appearance and characterized by urgent necessity is determined, and emergency work that aims only to remove dangerous deformities resulting from accidents in order to indicate the foundations on which the criminal responsibility of the plastic surgeon is built, with an explanation of the reasons for the criminal responsibility of artificial intelligence in order to impose penalties commensurate with its nature.
