|a يهدف البحث في دراسته إلى: توضيح المفردات ذات الصلة بالموضوع مثل (إشكالية، والحضانة، والولاية المالية، والصغير، والقاصر، الأحوال الشخصية... إلخ)، وكذلك التوصل إلى إشكالية الجمع بين الولاية المالية للحاضن على المحضون في ضوء الفقه الإسلامي وقانون الأحوال الشخصية بتعديلاته المختلفة، وتوضيح أثر ذلك على مصلحة الصغير، والتوصل لحل هذه الإشكالية بما هو متفق شرعا وقانونا وفي ضوء القواعد الفقهية والمقاصد الشرعية، متبعا المنهج الاستقرائي والتحليلي والمقارن. ثم متوصلا لأهم النتائج وهي: الحضانة: تربية الولد والقيام على رعايته بما هو لازم شرعا وعرفا وقانونا، ولقد راعت الشريعة الإسلامية في جميع الولايات على الصغير مصلحته وتعياها القضاء في أحكامه. مختتما بأهم التوصيات وهي: التوجه لبحث الإشكاليات المعاصرة في مناحي الأحوال الشخصية بما يتفق مع إشكاليات المستجدات المعاصرة، والجمع بين الدراسات الفقهية والقانونية في البحث العلمي، وإفراد جزء من المقررات الجامعية في مرحلة الإجازة العليا والدراسات العليا، ولبحث إشكاليات الواقع المعاصر في مجال الأسرة، وربط كل هذا بالقواعد الفقهية والمقاصد الشرعية.
|b The research aims to: Clarifying the relevant vocabulary such as (Problematic, Custody, Financial Guardianship, Minor, Personal Status etc.), as well as reaching the issue of combining the financial guardianship of the custodian over the child in the light of Islamic jurisprudence and the Personal Status Law with its various amendments, clarifying the impact on the interest of the child, and reaching a solution to this issue in what is legally and legally agreed and in the light of jurisprudential rules and legal objectives, using the inductive, analytical and comparative method. The most important findings are as follows: Custody: The Islamic Shari'ah has taken into account the interests of the child in all guardianships and the judiciary has taken into account the interests of the child in its rulings. In conclusion, the most important recommendations are as follows: Combining jurisprudential and legal studies in scientific research, devoting part of university courses at the graduate and postgraduate levels to researching contemporary issues in the field of personal status in line with the issues of contemporary developments, and linking all of this to jurisprudential rules and poetic objectives.
